Terms & Conditions
Any person who uses the Website to or bid for goods accepts the terms and conditions of this User Agreement, without change. Every time you bid for an item on the Website you agree to the terms and conditions of this Agreement. By registering for and using our service you further agree to be bound by all terms and conditions and all policies and guidelines listed on the Website and incorporated by reference.
Bidzforit reserves the right to change any of the terms and conditions contained in the User Agreement or any policies or guidelines governing the Website or Services.
You should only use the Website if you agree to the terms and conditions of the User Agreement.
1. Registration
1.1. Only persons over 18 years and who are capable of entering into a binding contract may register and use the Website.
1.2. When you register you must give us your real name, address, telephone number and e-mail address.
1.3. You must choose a user name and password. It is your responsibility to keep your user name and password confidential so as to prevent any unauthorised person making use of them. You are responsible for any transactions made using your user name and password.
1.4. You may update your details at any time
1.5. We recommend you change your password from time to time to maintain security.
2. Communication
2.1. We will attempt to send e-mails to your registered e-mail address to advise you when you have been successful with an auction.
2.2. We are not responsible if you do not receive e-mails from us for any reason.
2.3. We will not sell your e-mail address to any other party.
2.4. It is your responsibility to ensure the e-mail address shown is correct.
3. Bidding
3.1. You make a bid by entering the amount you wish to bid on the Website.
3.2. Bid bidding you are representing to us that your credit card has sufficient available funds to complete the transaction should you be the winning bidder.
3.3. Bids cannot be changed or retracted when they have been made.
3.4. Bids which we accept must be at or in excess of the minimum bid shown on the Website for the particular item.
3.5. You win a bid if you are the first bidder with the lowest bid, and you will be notified immediately if your are successful in the auction.
3.6. By bidding you represent to us that you will complete the contract if you are the winning bidder and accept the condition that you cannot refuse to accept the goods and cannot return the goods to us except in accordance with this Agreement.
3.7. In the event a bid is not registered by us whether because of technical fault or for any other reason we take no responsibility for any damage or loss suffered by the bidder.
4. Payment
4.1. when you have won an auction shortly after the auction we will send an e-mail advising you of your winning bid and which represents an invoice showing the amount of the winning bid (ie the bid multiplied by the quantity), together with the other amounts relating to the item including the freight charge, plus any other charges you may have incurred.
4.2. All Amounts Due are in Australian Dollars.
4.3. Immediately once an auction is completed you will have to enter in your current credit card to be charged.
4.4. You warrant that the credit card nominated by you when placing a bid shall enable you to make full and immediate payment of the Amount Due if your bid becomes the winning bid.
4.5. If we are unable to charge the full amount of the Amount Due to your credit card for any reason you will be prompted to enter in another credit card which will then lead to another scenario
4.5.1. if the amount does not go through you will lose the product that you have bid for and will not get an opportunity to purchase it again as you have lost that unique price
5. Delivery, insurance and risk
5.1. Delivery will be made only after the Amount Due has been received
5.1.1 and all products in that auction are sold
5.1.2 or the auction has reached the end date.
5.2. Any special delivery conditions and details are listed in the Auction catalogue.
5.3. We will make reasonable efforts to advise you of an approximate delivery day and time, but we are not responsible if the delivery is made at a different date and time. For this reason you should select a delivery address which is always attended during business hours.
5.4. Delivery will be made to your nominated delivery address and title will pass only after the goods have been receipted by you or a nominated person and payment has been made in full.
5.5. All goods must be receipted and signed for by a person. The address supplied to us will be deemed the correct delivery address. Our terms and conditions only allow for one delivery and any subsequent deliveries required will attract a surcharge of an amount not greater than the original freight charge. You authorise us to charge any such amount to your credit card.
5.6. Any changes to the delivery address must be made prior to the auction closing. The delivery address will be shown on the e-mail advising you that you won the bid and if you respond to that e-mail advising us of a change in the delivery address we will make reasonable efforts to change the delivery address to the revised one prior to despatch of the goods, but take no responsibility if we are unable to do this.
5.7. If you nominate a delivery address where the freight charge is higher than the freight charge included in the Amount Due, you authorise us to charge your credit card with any additional cost.
7. Returns
6.1. You cannot return or refuse to accept an item won in an auction just because you change your mind.
6.2. We will only accept returns in accordance with this Agreement.
6.3. If you wish to return an item you must e-mail us on returns@bidzforit.com.au and advise us that you wish to return the goods. The only circumstances in which we will accept returns are:
6.3.1. If the goods were damaged in transit,
6.3.2. If the goods do not work when properly installed and they cannot be repaired under warranty, or
6.3.3. If the description of the goods in the catalogue is materially incorrect (please note that photographs of the goods may be indicative and not a photograph of the actual item)
6.4. We will respond to your request to return the goods within three working days and either
6.4.1. Agree to accept the return, in which case we will contact you to arrange to collect the goods, or
6.4.2. Refuse to accept the return, if in our reasonable opinion the circumstance is not one of the three valid reasons for return.
6.5. Your right to return goods expires one week after delivery of the item(s). Please refer to the Trade Practices Act and your State/Territory law to determine if they provide alternatives that can not be excluded by contract.
6.6. If we agree to accept the return, we will inspect the goods and if they are faulty, either repair, replace or refund the item (at our option). If the goods are found not to be faulty, we will return the goods to you and you may be charged an additional freight cost. You authorise us to change any such freight cost to your credit card.
6.7. Subject to your rights under any State or Commonwealth law, if an item is sold by Bidzforit, and the item includes a manufacturer's warranty, Bidzforit will take no responsibility for the content, fulfilment or enforcement of that manufacturer's warranty. It shall remain the buyers responsibility to contact the manufacturer in relation to all queries and claims relating to the manufacturer's warranty.
7. Taxes
7.1. All goods sold on Bidzforit are inclusive of GST, unless otherwise stated in the auction catalogue.
8. Date and Time
8.1. All times quoted in the Website are approximately the same as Melbourne, Australia Time.
8.2. Melbourne Time is also referred to as Australian Eastern Standard Time (AEST) or Australian Eastern Daylight Time (AEDT). The time on the Website will be determined by the Bidzforit web server and may be different to the official Melbourne Time
8.3. We take no responsibility if the time shown on our Website differs from Melbourne Time.
9. Privacy Policy
9.1. Our Privacy Policy, which forms part of this Agreement, is set out on the Website.
9.2. Bidzforit may from time to time make changes to the Privacy Policy. Any substantial changes will be notified to all registered users of Bidzforit, by e-mailing their registered e-mail addresses.

10. Disclosure of Information
10.1. Bidzforit reserves the right to report to the appropriate authorities any activity that it suspects violates any law or regulation.
10.2. In order to cooperate with information requests, to allow users to resolve disputes or to ensure the integrity of our website and systems or other purposes deemed reasonable, Bidzforit may access and disclose any information it considers necessary or appropriate, in accordance with the Privacy Policy.
11. Copyright
11.1. All material on the Website is subject to copyright. You may use this material for your own personal reference only. Except for the temporary copy held in the computer's cache and a single permanent copy for your personal reference, the material may not be copied, reproduced, published, stored in a retrieval system, altered, transmitted in any form or by any means in whole or in part or otherwise disseminated to others (except where such use constitutes fair dealing under the Copyright Act of Australia) without the prior written approval of Bidzforit.
12. Breakdown
12.1. In the event of breakdown or unavailability of the Website for any reason we may suspend the service, in which case we take no responsibility for any losses suffered by any bidders, whether actual or contingent.
13. Our Obligations and Liability
13.1. We do not guarantee that the Website will always be available and take no responsibility if for any reason it is unavailable for any period of time.
13.2. Regardless of any loss or damage suffered by you for any reason our liability will be nil in respect of any dealings you may have with us except that in the event of your purchase of a product from us which proves to be faulty we may have a liability to replace, repair or refund in respect of such product and you agree that our liability in all such cases is limited to a maximum sum equal to the Amount Due notwithstanding any further losses or damage you may have suffered.
14. Suspension of Service
14.1. If we believe you have acted in a way which contravenes any of the terms of this Agreement, or for any other reason, we may at our absolute discretion suspend or cancel your access to the Website.
14.2. If your access to the Website has been suspended or cancelled you cannot re-apply to become registered without our written consent.
14.3. Suspension by us or cancellation of your access to the Website does not reduce or mitigate any amounts you owe us under this Agreement whether actual or contingent and whether claimed by us or not.
15. General Terms
15.1. In this Agreement headings are for convenience only.
15.2. This Agreement and the general terms, conditions set forth on the Website, constitute the entire agreement of the parties with respect to the subject matter hereof.
15.3. If any provision of this Agreement shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.
15.4. Any failure by us to enforce the strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provisions of this Agreement.
16. Termination.
16.1. We may, in our sole discretion, terminate or modify this Agreement, access to the Site or the Services, or any current transaction immediately without notice for any reason.
17. Indemnity.
17.1. You agree to indemnify and hold harmless Bidzforit, any related companies of Bidzforit, their directors, officers, employees and agents from any losses, claims or costs arising from:
17.1.1. Your breach of this Agreement,
17.1.2. Your violation of any law or regulation, and/or
17.1.3. Your violation of any third party's rights.
